The inclusion of the Customer’s own terms and conditions is hereby expressly excluded, unless otherwise agreed. 1.2 These GTC shall apply accordingly to contracts for the supply of vouchers, unless expressly stated otherwise. 1.3 For the purposes of these GTC, a consumer means any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession. 1.4 For the purposes of these GTC, a trader means any natural or legal person or partnership with legal personality who, when entering into a legal transaction, acts in the exercise of his or her trade, business or profession. 1.5 The subject matter of the contract may, depending on the Seller’s product description, be the supply of goods either as a one-off delivery or on a continuing basis (hereinafter “subscription contract”). If the Customer has created a user account prior to placing the order, the order data will be archived on the Seller’s website and can be accessed via his or her password-protected account. 2.7 Before submitting the order, the Customer can identify and correct any input errors by carefully reviewing the information displayed on the screen. 2.8 The contract language shall be German. 2.9 Order processing and communication usually take place by e-mail. If the Customer acts as a consumer, the risk passes upon receipt of the goods. 5.4 The Seller reserves the right to withdraw from the contract in cases of incorrect or improper self-supply. The Seller shall make reasonable efforts to procure the goods. If unavailable, the Customer will be informed promptly and refunded. 5.5 Collection by the Customer is not possible. 5.6 Vouchers are provided by e-mail. --- 6) Term and Termination of Subscription Contracts 6.1 Subscription contracts are concluded for an indefinite period and may be terminated by the Customer at any time without notice. 6.2 The right to terminate for cause remains unaffected. 6.3 Termination may be made in writing, by e-mail, or via the cancellation button on the Seller’s website. --- 7) Retention of Title If the Seller makes advance deliveries, ownership of the goods remains with the Seller until full payment of the purchase price. --- 8) Liability for Defects (Warranty) Unless otherwise provided, statutory provisions on liability for defects apply. For contracts for the delivery of goods, the following deviations apply: 8.1 If the Customer acts as a trader: - The Seller may choose the type of subsequent performance. - For new goods, the limitation period for defect claims is one year from delivery. - For used goods, defect rights are excluded. - The limitation period does not restart following replacement delivery. 8.2 The above limitations do not apply to: - Claims for damages and reimbursement of expenses. - Fraudulently concealed defects. - Goods used for a building and which caused its defectiveness. - Any obligation to provide updates for digital elements of goods. 8.3 For traders, statutory limitation periods for rights of recourse remain unaffected. 8.4 If the Customer is a merchant, he or she must comply with the duties of inspection and notification under Section 377 HGB. 8.5 If the Customer is a consumer, he or she is requested to report any obvious transport damage to the carrier and inform the Seller accordingly. --- 9) Liability 9.1 The Seller is liable without limitation: - For intent or gross negligence. - For injury to life, body or health. - Under any guarantee. - Under mandatory statutory liability, such as the Product Liability Act. 9.2 If the Seller negligently breaches a material contractual obligation, liability is limited to foreseeable, typical damage. 9.3 Any further liability of the Seller is excluded. 9.4 The above provisions apply also to the Seller’s representatives and vicarious agents. --- 10) Redemption of Promotional Vouchers 10.1 Promotional vouchers issued free of charge for a specific period may be redeemed only in the Seller’s online shop within the specified period.
